1. General principle

Properties in Spain are normally sold as-is unless otherwise agreed.

This means:

  • buyer responsibility is greater than in Sweden

  • undocumented items are deemed accepted

  • clarity before completion is essential

2. What is included in the purchase

Only what is documented is legally included.

Always specify:

  • furniture

  • appliances

  • TVs

  • air conditioning units

  • washing machine / dryer

  • fixed installations

Auriga recommends a written inventory, photos and contract annex.


3. Missing items at completion

If agreed items are missing, the buyer may:

  • withhold part of the payment (if agreed in advance)

  • request compensation

  • in some cases, cancel parts of the agreement

Without documentation, claims are difficult.

Buyers are responsible for:

  • inspection

  • understanding condition

  • accepting visible defects

5. Hidden defects in Spain

Legal protection is weaker than in Sweden.

Seller liability applies mainly if defects were known and deliberately concealed.

Preventive inspection is essential.
